This article seeks to contribute to ongoing debates on the nature and foundations of environmental law. In doing so, the article accepts the claim made in much of the recent analytical environmental law scholarship that the discipline suffers from a lack of coherence. In a response to this claim, the article probes the potential reasons behind this incoherence. In relying on recent scholarship in the disciplines of social psychology and cultural cognition, the article argues that individual understanding of environmental risks (...) in accordance with a priori held beliefs and values aided by cognitive biases, lends support to a scenario of multiple and diverse understandings of environmental problems. This diversity is in turn reflected in both the form and content of environmental law. In a response to this diversity and incoherence, the article identifies the philosophy of pragmatism and argues that a modest interpretation of pragmatism has the potential to alleviate the biases and heuristics that give rise to the individual understanding of environmental risks. The leitmotif of the German contribution to the 12th Architecture Biennial in Venice, “desire“, is at the same time the topic of a survey among architects ; answers are given through drawings. What are you longing for? The response drawings are highly individual, diversity becomes programme: both in picture language and in the presentation in terms of content, reactions are quite different. But there is one thing they all have in common: the burning desire of something concrete. Sometimes it spreads (...) lightning-like on the observer, sometimes time is required for a contemplative involvement with form and content. This paper focuses on the importance of wonder in human flourishing and is orientated towards the dynamics between the two, but with an emphasis on how the former is important for illuminating the latter. It begins with a preliminary sketch of both wonder and human flourishing and subsequently moves on to highlight three aspects of human flourishing: 1) ‘Individuality’, 2) ‘Relations’ and 3) ‘The political’, and why these play to wonderment.

From a cultural-historical perspective, the impairments of a child with a condition like cerebral palsy have biological origins, but the disability evolves from the mismatch between the child and his/her social conditions for development. One example of this dialectical production of disability can be seen in the challenge of the 21st-century welfare state: How to provide economically feasible health and educational services anchored in evidence-based methods and practices. Standardized social service pathways for children with CP illustrates an attempt to address (...) this challenge and moderate the mismatch by acting in the intersection between impairment and society. The aim of the article is to analyze challenges in the practice of connecting research and practice-based knowledge with societal practices in order to diminish the disability of the child. A multidisciplinary group assembled by the Danish National Board of Social Services engaged in a practice of developing a guideline for a social service pathway. Agendas and minutes from their series of meetings provide insight in how the work evolved through conflictual discussions. Rather than a neutral transformation of knowledge into practice, the practice revealed itself as a value-laden process in which the needs of the child and family were at times decentred and the focus shifted to how social services could be realised in complex, structured social practices. While the group managed to overcome several conflicts and agree of a social service pathway, a socio-economic analysis was unable to argue for the comprehensive social service pathway as an economic sound choice for municipal decision-makers. The conflict between the welfare ideology and economic feasibility remains unresolved and can be expected to limit the extent that impairments can be remedied and the mismatch decreased. Overcoming or diminishing the mismatch might never become economic worthwhile. As the political pendulum oscillates between welfare and economic concerns, the experience of disability will likewise diminish or expand. (shrink)

Arts and Humanities in Higher Education, Volume 21, Issue 2, Page 198-219, April 2022. This article presents playfulness as an emerging approach to learning in higher education that emphasises the arts and humanities across disciplines. The article is based on a qualitative, hermeneutical literature review in light of educational culture in higher education. The literature review indicates that playful approaches to learning stand in opposition to educational cultures that focus on rapidness and student performance. However, an educational culture of play (...) is about to establish itself, and this culture of play emphasises creativity in learning and human flourishing in education, perspectives that are connected to arts and humanities. The main findings cultures of time, performance and play lead to several questions about societal, institutional, and organisational educational culture, and regarding approaches to teaching, learning, humanity and society. The main contribution of this article is that a focus on playfulness offer the field of arts and humanities new possibilities in future education. (shrink)

Various authors see human flourishing as the overarching aim to which education should contribute. We ask whether fostering _wonder_ can help education attain this aim. We discuss two possibilities: firstly, it may be that having a sense of wonder as adults (possibly fostered by and/or refined due to education) contributes to flourishing itself. Secondly, it may be that fostering wonder in education increases the likelihood that education promotes flourishing, which it might do simply by increasing children’s intrinsic interest in what (...) they learn. We argue that there are many plausible connections between wonder and human flourishing (relating to its epistemic and aesthetic dimensions, among others), and that we have reason to believe that early experiences can influence adults’ capacity for wonder. Furthermore, wonder increases the likelihood that education ‘succeeds’; and it supports people’s ability to live well by heightening their appreciation for the world, helping to uncover baseless beliefs, and increasing their awareness of possible goods. In sum, while having a sense of wonder may not be a constitutive element of human flourishing, it is hard to imagine education for human flourishing that is not also wonder-full education. (shrink)

It is a central political goal to secure disabled individuals the same opportunities as others to pursue their conception of a good life. This goal reflects an ambition to combine an egalitarian and a liberal moral intuition. In this article, we analyse how disabled individuals who take part in economic activity should be compensated in order to respect these two intuitions. The article asks how a system of disability compensation should be structured and what the level of such compensation should (...) be. It also analyses how the answers to these questions depend on whether the disabled individuals are held responsible for their choice of work effort. (shrink)

In Balanced Wonder, Jan B. W. Pedersen digs deep into the alluring topic of wonder, in dialogue with Neo-Aristotelian philosophers, arguing that the experience of wonder, when balanced, serves as a strong contributor to human flourishing.

Although research has examined factors influencing understanding of informed consent in biomedical and forensic research, less is known about participants' attention to details in consent documents in psychological survey research. The present study used a randomized experimental design and found the majority of participants were unable to recall information from the consent form in both in-person and online formats. Participants were also relatively poor at recognizing important aspects of the consent form including risks to participants and confidentiality procedures. Memory effects (...) and individual difference characteristics also appeared to influence recall and recognition of consent form information. (shrink)

Howard Phillips Lovecraft’s work of fiction can roughly be grouped into three distinct categories, each evoking a singular extraordinary state of mind. Poe-inspired tales of the macabre such as “The Tomb” (1917) and “The Statement of Randolph Carter” (1919) produce terror because of the atmosphere they convey and because of the particular end the main characters meet. Lovecraft’s later “Yog-Sothothery” or work in the Cthulhu Mythos tradition, including his signature pieces of weird fiction “The Call of Cthulhu” (1926) and “The (...) Shadow over Innsmouth” (1931), inspires ‘horror’ because the life-worlds of the protagonists in these stories are utterly destroyed. However, the gentleman of Providence is also known for a different sort of fiction. His Dunsanian tales—among them short stories such as “The White Ship” (1919), “Celephaïs” (1920), and the three works“ The Silver Key” (1926), The Dream-Quest of Unknown Kadath (1926–27), and “Through the Gates of the Silver Key” (1932–33; with E. Hoffmann Price), centered on the exploits of Lovecraft’s recurring character and alter ego Randolph Carter—are epitomes to this feat. These prehistoric or dreamland tales do not inspire ‘terror’ or ‘horror’; rather, they predominately seek to evoke the extraordinary state of mind called ‘wonder. This article offers a preliminary exploration of Lovecraft’s relationship with wonder, highlights what wonder is, how Lovecraft was exposed to wonder at an early age, and argues that he developed a lifelong positive relationship with this particular state of mind. One of the vexed questions in the philosophy of wonder and indeed education is how to ensure that the next generation harbours a sense of wonder. Wonder is important, we think, because it encour- ages inquiry and keeps us as Albert Einstein would argue from ‘being as good as dead’ or ‘snuffed-out candles’ (Einstein 1949, 5). But how is an educator to install, bring to life, or otherwise encourage a sense of wonder in his or her stu- dents? Biologist Rachel (...) Carson suggests that exploring nature and specifically undertaking walks along the rocky coast of Maine would keep alive a person’s inborn sense of wonder (Carson 1984). Philosopher Jesse Prinz thinks that exposure to art will encourage wonderment because artworks, as he puts it, are “inventions for feeding the appetite that wonder excites in us” (Prinz 2013). Weird fiction (a subgenre of speculative fiction) – and in particular the work of one of its greatest exponents, the early-20th-century American author How- ard Phillips Lovecraft – is likewise a catalyst for wonder. The reason behind this is that Lovecraft’s ‘wonder-stories’ are densely packed with wonder per design; and in support of this claim I shall in what is to come 1) provide a brief introduction to Lovecraft and weird fiction; 2) present a working definition of wonder; and 3) clarify what is meant by something being ‘densely packed with wonder’ via bringing to the fore evidence of Lovecraft’s literary wonder- mongery. The paper ends with some reflections on the notion of ‘dark wonder’, why this peculiar label might be suitable for the kind of wonder we find in Lovecraft’s work, and why exposure to ‘dark wonder’ can be edifying, and in that sense educational. Drawing on both anthropology and philosophy, this paper argues that the profiled form of the human hand is a universally recognizable image; one whose significance transcends temporally and geographically defined cultural divisions, and represents the earliest known artistic symbol of the human form. The unique co-occurrence of five properties in the image of the human hand and the way it is recognized support this argument, including that it is: (1) unmistakably a hand, (2) unmistakably human, (3) a universal point of (...) interface, (4) a universal referent of scale, and (5) an easy way of making a complex shape. This underappreciated aspect of hand art makes these images among the most important forms of early artistic expression encountered in the prehistoric record. (shrink)

In earlier writings, I have sought to establish a link between Howard Phillips Lovecraft and Romanticism, and this paper adds to that body of work. -/- The essay begins with a preliminary sketch of the use of gardens in Romantic thought and the highlighting of six themes: contemplation, joy, the dramatic, the strange, the foreign, and the beautiful, that all underpins Romanticism. -/- This is followed by an elucidation of Lovecraft’s fascination with gardens, his dealings in Romantic themes, and what (...) role they play in his short 1917 poem “A Garden”. -/- The essay concludes that given Lovecraft’s love of gardens and that his poem “A Garden” is imbued with Romantic themes and involves ‘wondrous contemplation’ and ‘poetic knowledge’, the case for his Romanticism has been strengthened. Kapitlet starter med at se nærmere på, hvordan patientinddragelse italesættes i vor tid efterfulgt af en (...) kort eksposition af to af oplysningstidens vigtigste libera- le filosoffer, herunder pligtetikeren Immanuel Kant og nytteetikeren John Stuart Mill, hvis syn på henholdsvis autonomi og frihed influerer debatten om patientinddragelse. Efterfølgende præsenteres og diskuteres to eksempler, hvor patientinddragelse og etik er i rampelyset. Mere specifikt rettes fokus på 1) etik, patientinddragelse og den psykiatriske patient og 2) etik, patientinddragelse og unge mennesker. Howard Phillips Lovecraft can be viewed as a Romantic based on his lifelong relationship with wonder. This short essay gathers further evidence of Lovecraft’s Romanticism, beginning with a brief exploration of what Romanticism is and then moving on to highlight elements of Romanticism in Lovecraft’s poem “Fact and Fancy” (1917). The essay concludes that, as much as Lovecraft can be labelled a Romantic based on his affinity with wonder, he can also be classified as such based on his aversion to (...) the cold light of reason, which to him was an insufficient antidote to the otherwise dreary world in which he found himself. Lovecraft’s teetotalism is well known among Lovecraftians, but the lengths to which he went to incorporate his views and how he sought to influence the people around him via his various writing remain relatively unexplored. This essay focuses on Lovecraft’s teetotalism and opens with a brief sketch of the historical background from which his dry outlook emerged. It continues by providing evidence for Love- craft’s advocacy of abstinence and Prohibition from a variety of sources, including biographical material, philosophical essays, letters, (...) poetry, and fiction, with a view to showing how he communicated his dry philosophy and how it softened as he advanced into middle age. The essay ends by arguing that although there can be no doubt that Lovecraft was a teetotaler par excellence, his later softened position is more balanced and rooted partly in the realization of his own idiosyncrasy and anachronism. According to the Norwegian philosopher Peter Wessel Zapffe, human life is filled with so much suffering that procreation is morally impermissible. In the first part of this paper I present Zapffe’s pessimism-based argument for anti-natalism, and contrast it with the arguments for anti-natalism proposed by Arthur Schopenhauer and David Benatar. In the second part I explore what Zapffe’s pessimism can teach us about biomedical enhancement. I make the case that pessimism counts in favor of pursuing biomedical enhancements. The reason is (...) that the worse we take the baseline human condition to be, the stronger are our reasons to try to alter humanity, and the weaker are our reasons to fear technology-driven extinction. The prospect of enhancement, I further argue, gives pessimists a reason to reject anti-natalism. (shrink)

The paper lists all the predictions and observations of eclipses of Jupiter's satellites 1668–1678 and compares them with modern computations of the these eclipses by J. H. Lieske. We discuss Roemer's method that led to his discovery of the retardment of light and finally we shall interpret Roemer's calculations.

Nowadays there are many spaces of fascination in visual art. Of course, installative space and contextual space have been on the art scene for awhile. However, they are now accompanied by other spaces such as urban space, architectural space, cyberspace, hyperspace, and screen-based space. In this volume, architects, artists, theorists, three symposia and four exhibitions attempt to find answers to questions such as: Could the architectonic study and/or deconstruction of space play a decisive role in the shift of attention to (...) space? Which theoretical factors structure the current experience and meaning of space? What is the role of the aesthetization of the environment on our concept of space? A common objection to paternalism concerns its expressive content. Many reject paternalistic policies and actions on the ground that they arguably involve insulting expressions of disrespect toward those subjected to them. The paper challenges this view. It argues that refraining from acting paternalistically can be disrespectful. Specifically, the paper argues that there is a relevant way in which A disregards the moral worth of B if A stands idly by when B is about to act very imprudently. If true, treating (...) others with equal respect and concern, as relational egalitarians and others rightly ask us to do, will somewhat surprisingly sometimes involve treating them paternalistically. In this article, I critically assess Hélène Landemore's new model of Open Democracy, asking whether it requires of citizens to blindly defer to the decisions of the mini-public. To address this question, I, first, discuss three institutional mechanisms in Open Democracy, all of which can be read to grant citizens democratic control. I argue that neither the capacity to authorize the selection mechanism (random sortition), nor the lottocratic conception of political equality, nor the self-selection mechanisms of Landemore's model deliver the (...) form of control that would insulate Open Democracy from the charge of blind deference. I then discuss the direct democracy mechanisms that Landemore incorporates into her model. Although these devices grant citizens control and, by extension, offer the resources for repudiating the charge of blind deference, they also, I argue, subvert the logic of Landemore's lottocratic model, rendering Open Democracy predictably unstable. Given the deliberative asymmetries between the mini-public and the citizenry, a high frequency of bottom-up challenges is to be expected that would throw the whole system into jeopardy. Thus, the challenge for lottocrats is to show how democratic control can be achieved in a lottocratic system without undermining the benefits of the legislature by lot. (shrink)

Logic isn’t special. Its theories are continuous with science; its method continuous with scientific method. Logic isn’t a priori, nor are its truths analytic truths. Logical theories are revisable, and if they are revised, they are revised on the same grounds as scientific theories. These are the tenets of anti-exceptionalism about logic. The position is most famously defended by Quine, but has more recent advocates in Maddy, Priest, Russell, and Williamson. Although these authors agree on many methodological issues about logic, (...) they disagree about which logic anti-exceptionalism supports. Williamson uses an anti-exceptionalist argument to defend classical logic, while Priest claims that his anti-exceptionalism supports nonclassical logic. This paper argues that the disagreement is due to a difference in how the parties understand logical theories. Once we reject Williamson’s deflationary account of logical theories, the argument for classical logic is undercut. Instead an alternative account of logical theories is offered, on which logical pluralism is a plausible supplement to anti-exceptionalism. (shrink)

In this chapter, we ask three questions about pedophilia: Is it immoral to be a pedophile? Is it immoral for pedophiles to seek out sexual contact with children? Is it immoral for pedophiles to satisfy their sexual preferences by using computer-generated graphics, sex dolls, and/or sex robots that mimic children? We argue that it is not immoral to be a pedophile, it is immoral for pedophiles to seek out sexual contact with children because of the expected harm to children, and (...) it is morally permissible for pedophiles to satisfy their sexual preferences in ways that do not involve any real children.
